Terms
1. Your initial deposit reserves your date and is non-refundable
2. We must receive the balance by the due date indicated or 1 week prior to the event (whichever comes first) or contract is null and void.
3. The date of your final payment is the final date for any changes of size, design or flavor of the cake.
4. Delivery and Setup charges are included in cakes priced $400.00 or more. Cakes below this price are subject to a $40.00 delivery charge for Odessa and $60.00 delivery charge to Midland and close surrounding areas. If delivery is out of surrounding area limit, a $1.00 dollar per mile will be charged in addition to our standard Deliver charge of $40.00.
5. We are not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 75 degrees or below.
6. If you or your representative elect to pick up the cake, you assume all liability and responsibility for the condition of the cake once it leaves The Cake Company of Odessa.
7. Our cakes are to be delivered no earlier than 2 hours before event to ensure freshness.
8. Our products may contain or come in contact with, milk, wheat, nuts, soy, and other allergens, You agree to notify your guest of this risk an hold us harmless for any and all possible allergic reactions.
9. Performance of this agreement is contingent upon the ability of The Cake Company of Odessa, LLC. to complete the agreement and is subject to accidents, Acts of God, and other causes beyond our Control.
